OFFICE OF THE CHIEF OPERATING OFFICER

 

                                                     DEPUTY DIRECTOR: CONTRACT MANAGEMENT

(LEGAL SERVICES)

POSITION CODE: 180029

TASK Grade 15 (R481 212 – R669 048 per annum)

(Basic salary only, excluding benefits)

 

Qualifications and experience required:

 

  • An appropriate tertiary legal qualification (NQF level 7).
  • Five years’ working experience in a municipal or public service legal environment.
  • Admitted as attorney or advocate (passed bar exam).
  • Understanding public sector procurement processes, corporate and administrative law as well as administration of by-laws, delegation of powers and related matters.

 

Key attributes and competencies:

 

  • A sound knowledge of the Municipal Systems Act, Municipal Finance Management Act, the Preferential Procurement Policy Framework Act, Supply Chain Management Regulations and other applicable local government legislation.
  • Knowledge of various types of contracts, e.g. JBCC, FIDIC and GCC.
  • Oral and written communication skills in English and at least one other official local language.
  • Computer literacy and excellent report-writing skills.

 

Job purpose:

 

  • Providing effective legal support and advice for standard and special agreements.
  • Ensuring compliance with general and specific conditions.
  • Monitoring contracts and service level agreements and ensuring that they are in line with legislative prescripts.
  • Initiating new contracts for the Municipality and performing audits on contracts.
  • Facilitating the drafting of specifications for directorates in accordance with approved formats.
  • Drafting, vetting and negotiating contracts and service level agreements for the directorates.
  • Giving legal comments on Council reports, as well as verbal and written comments to internal clients.
  • Instituting Court applications for the enforcement of the rights of the Municipality.
  • Planning the work of the Section, compiling and finalising the Section’s annual budget, and monitoring and controlling expenditure on the approved budget, in consultation with the Director: Legal Services.
  • Organising and coordinating the activities of the Section, and supervising the staff.
  • Database management of suppliers and contractors.
  • Ensuring the timely handling and disposal of all correspondence, enquiries, meetings and consultations regarding legal actions and disputes arising from the legal opinions supplied to the stakeholders.

  

As part of the selection process, candidates may be tested on any requirement, skill or competency, which will include pre-employment screening, security vetting and psychometric assessment.
